More that 16 million homes are in a negative equity  position.  With less than 2% of all loan modification applications being approved in 2010, and 95% of the 2% which were approved only resulted in a short term interest rate reduction, it's has become apparent that utilizing the judicial process (litigation) is the only means by which home owners can hope to achieve a true principal reduction via a transparent process.

Make no mistake, no credible attorney or firm can guarantee the results of litigation as there are many variables that can effect the outcome.  That said, there are credible, competent, and experienced firms which have valid complaints in both State and Federal Court's, and these complaints (law suits) are moving forward through the judicial process with a goal of principal reduction  down to at least the home's current market value.

The biggest problem that most Americans' face is cost.  Litigation for an individual can be financially unfeasable.  The absolute # 1 strategy of the Defense (the banks) employ is not to deny the allogatings, but simply to "paper the plantiff's to death".  Meaning that they (the defense) will file countless motions and demures, all of which warrant time an billable hours from the Plantiff's counsel.  Historically this tactic has worked in the sense that before the case has a chance to make it to the trial phase, the plantiffs run out of money to support the cause.  This is where mass plaintiff (Mass Joinder) litigation has proven to be a highly effective response.

Due to the fact that the merits of the case (or cause of action) are identical for each plantiff, the law firm and homeowner can benefit from an economies of scale via a shared cost model.  Typically for one very low retainer fee, the home owner can be added to an existing compliant, and reap the benefits of full representation all the way through trial or settlement.  In addition, the notion of power in numbers is undoubtedly a by product of the mass plaintiff strategy.  (When you have several thousand plaintiffs on one complaint it gets both the courts and banks attention)

Having been helping a Sheffield man just today with his steadfast mortgage battle vs the banksters, and having watched the footage linked below in 'The Mortgage Chronicles' once again for the first time in 6 months, I am as determined as ever to cut through the jungle of judicial bullshit and the repeated refusals of the courts to provide remedy. However, we need more people to join the battle against the banksters - if you know anyone who is in difficulty with a mortgage then direct them to the link. The Nottingham event - to be held in mid July, more details to follow - will focus on the representative actions - people are encouraged to bring along their mortgage documents, workshops will guide everyone in terms of whatever roles they wish to play (for instance, admin assistants, who will be the representatives, how the claims will be organised to coincide with each other, how the costs will be split and anything else that needs covering. By the end of the day each attendee should be clear as to what is required and so it will move it onto the next phase.
